Annual Maintenance Contract for Landscaping at Desert Sun Tower Jointly Owned Property, Dubai Land, Dubai, starting from 1st of January 2023 till 31st of December 2023

Mowing once a week when the grass is dry: adjust to avoid scalping/ catch clipping / change direction of cut each mow/ use of push mowers on new areas/ ride-on mowers are ok for bedded down areas where wheel won't cause track.

Edging once a week: each mowing cycle to be edges also / pathway and road edges cut / use walk behind steel blade edger for those areas / walls and around poles etc. to be cut horizontal at same height of mowing

Stakes and Ties monthly checking- Be sure to only keep on site requires, generally from 6-12 months dependent upon tree size and stability, keep stakes at uniform level and height and be sure ties are firm but allow some movement and sway. Trees should be placed at the base of tree to support root stabilization and another mid-way to support sway and crown bending.

Monthly Pruning / Shaping / Uplifting - unwanted stubs, tears and suckers to be removed / cleaned as required. Raise crown of mature trees to 1.8 to 2.0 m or to allow for adequate pedestrian and vehicular traffic

Fertilizing generally six (6)times a year / it is recommended that during these early stage of growth of soil test analysis similar to that taken for the turf areas is used to determine values of garden bed areas as there is much building materials being dumped into garden / also suggest an anti-evapotranspiration agent such as 'ENVY' be used to assist trees an d shrubs

Remove by hand only at this early stage and given to the areas are very small at this point / all trees pits should have an equal and uniform circumference surrounding. Suggesting 500mm radius template made and this area kept clear particularly in turf areas where there is no paved edges

Pest Control

General monitoring for any occurrence of pests affecting the plants, grass, shrubs or trees. Pest control application for insects only applied to agriculture related infections. Public health control like ants, flies, cockroach, mosquitoes are not included in our scope of work.

Irrigation

Inspection of the irrigation system on visit basis to assure the sufficiency of the Automatic Irrigation System including the following:

-Flashing of the lateral lines, if required.

-Flashing of drip lines

Checking and adjust the nozzles of sprayers and sprinkles

-Checking the drip system and changing or replacing of on-line emitters

Asset list to be prepared and verified by the service provider at site by visiting the locations and to be included in proposal.

Terms & Condition


No Subcontracting: In accordance to Jointly Owned Property Law No.6,2019, Notwithstanding anything in this Agreement, the vendor/contractor may not use any subcontractor to perform any of his obligations under this work order. Unless: 

(a) Vendor has obtained the prior written consent of Mansions CM to the use of the subcontractor, and 

(b) Vendor has entered into a separate written agreement with the subcontractor which requires the subcontractor to agree to and abide by all the terms and conditions of this Agreement. 

The Community shall be deemed to be a third-party beneficiary of any such agreement between the vendor and a permitted subcontractor. 

Notwithstanding the foregoing, the vendor shall not be relieved of any of its duties or obligations under this Agreement as a result of entering into a written agreement with a permitted subcontractor.



Payment will be done after work completion upon submitting the invoice along with work completion/service reports/warranty certificates.



NOTE TO VENDORS
As per the rules, all vendors supplying services in the Emirate of Dubai must have trade license issued by relevant authority in the Emirate of Dubai. 
Before you apply for any job in the Emirate of Dubai, please make sure to comply with regulatory requirements. 
Failure to do so can result in stoppage of funds through Escrow Account.
Mansions CM, bears no liability towards any payment that is withheld by the Escrow Operator.


1)      The contractor/service provider must have and maintain a valid and appropriate license in the Emirate of Dubai in order to provide the services under the scope of work of this agreement.

2)      NO sub-contracting shall be permitted under this agreement.

3)      The contractor/service provider warrants and guarantees that there is no conflict of interest, nor the relationship between the company and/or any of its officers, the Owners Association Management, and/or any of the Board/Committee Members.

4)      The contractor/service provider undertakes that will not accept or have given any commission, any form of inducement, bribe, kickback, offering, or anything of value to the Developer or other party involved in the award of this Management agreement for its duration for purposes connected with this agreement and which gives rise to, or is likely to give rise to, a material conflict of interest between the Managing Agent and the Owners Association.

The agreement may be terminated by either party without any cause by giving the other party 1 month/30 days prior written notice thereof.
